Terms of use
These Terms govern your use of Level Up, the adaptive math practice service operated by Playful Digits SRL. They form a contract between you, the parent or legal guardian, and us. Please read them carefully.

About these terms
Level Up ("the Service", "we", "us", "our") is operated by Playful Digits, the company behind Level Up and the merchant of record for every subscription sold through the Service. You can reach us in the United States by post at Playful Digits, 14205 N MoPac Expy, Ste 570, PMB 142266, Austin, TX 78728, USA (full operating-entity details under Operator details below). These Terms of use, together with our Privacy Policy and Data Processing Agreement, form the entire agreement between you and us regarding the Service.
By creating a parent account, paying for a subscription, linking a child device, or otherwise using the Service, you confirm that you have read these Terms, that you have the legal capacity to enter into this agreement, and that you accept the Terms in full. If you do not accept the Terms, do not use the Service.
We use plain language wherever possible. Where a clause uses defined terms (shown in bold the first time they appear), the meaning is set out in the Definitions section below.
Definitions
The following terms have the meanings given to them here:
- Account: the parent account you create to access the Service, manage child profiles, and pay for a subscription.
- Child Profile: a profile you create within your Account representing a child you are responsible for, used by Level Up to deliver personalized math practice.
- Linked Device: a tablet, Chromebook, computer, or other device you have linked to a Child Profile so the child can practice without logging in.
- Subscription: a paid plan that grants you and the children on your Account access to the practice features of the Service.
- Free Assessment: the initial 40-question adaptive assessment and the AI-generated report we produce from it. It is included in the Free Trial at no additional charge, and we may also offer it on its own through specific invitation links.
- Free Trial: any time-limited evaluation period of the paid Subscription that we may offer. A Free Trial requires payment information up front and converts into a paid Subscription at the end of its term unless you cancel first; the length, the first-charge amount and the first-charge date are all disclosed to you before you provide payment details.
- Content: practice problems, hints, worked solutions, dashboards, assessment items, AI-generated reports, interactive elements, audio, video, and any other material made available through the Service.
Eligibility and the parent contract
The Service is offered as a parent-managed product. Only adults, at least eighteen (18) years old or the age of majority in the jurisdiction where you reside, may create an Account and enter into this agreement. By creating an Account you confirm that you are the parent or legal guardian of the children you register on the Account, or that you are otherwise lawfully authorized to make decisions about their education and online services.
The Service is not designed to be purchased or contracted by minors. Children may use the Service only through a Linked Device that you have set up under your Account, and their use is governed by the parental supervision you provide.
Where applicable laws require additional consent for the processing of children's personal data, for example the EU General Data Protection Regulation (GDPR), the Romanian implementing legislation (Law 190/2018), the United States Children's Online Privacy Protection Act (COPPA), or similar, your acceptance of these Terms together with the information provided in the Privacy Policy constitutes the verifiable parental consent required for us to deliver the Service to your child. You may withdraw that consent at any time by deleting the Child Profile or closing the Account.
Your account and child profiles
You are responsible for the accuracy of the information you provide when creating an Account, for keeping your login credentials confidential, and for everything that happens under your Account. You agree to notify us promptly at moc.htampulevel@lagel if you suspect that your Account has been accessed without your authorization.
You may add one or more Child Profiles to your Account. For each profile we ask only for the minimum information needed to teach: a first name (or chosen handle), a grade level, and an optional unit-system preference (metric or U.S. customary). We do not ask for last names, dates of birth, gender, photos, voice or video, or contact details for children.
You may edit or delete a Child Profile at any time from the parent dashboard. Our data retention practices for deleted profiles are described in the Privacy Policy.
Device linking and child access
Children access the Service through a Linked Device. You initiate device linking from the parent dashboard; we generate a short-lived pairing code (a six-character alphanumeric code, also expressed as a QR code), and the device is associated with the Child Profile after the pairing is completed.
Linked Devices authenticate using opaque, revocable device tokens, not username-and-password credentials. Tokens are scoped to a single Child Profile on a single device, are valid for up to three hundred sixty-five (365) days, and do not expose internal user identifiers. You may revoke any Linked Device from the parent dashboard at any time. Once revoked, the token can no longer be used to access the Service.
You are responsible for the devices on which you choose to install or open the Service, including any connectivity costs and any third-party agreements (operating-system providers, app stores, internet service providers) that apply to those devices.
Acceptable use
You agree to use the Service only for its intended educational purpose and only through the interfaces we provide. You agree not to:
- attempt to circumvent security or access controls, including any rate limits or authentication mechanisms;
- scrape, copy, redistribute, resell, or commercially exploit the Content without our written permission;
- reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service, except to the extent that applicable law expressly permits;
- interfere with, disrupt, or impose unreasonable load on the Service or its infrastructure, including by uploading malicious code or overwhelming our servers;
- use the Service to harass anyone, to infringe a third party's rights, or in a way that violates applicable law.
We may suspend or terminate Accounts that, in our reasonable judgment, are being used in breach of this section. Where the breach is minor and curable, we will normally contact you first to give you a chance to resolve it.
The initial assessment and report
The initial assessment, which includes a 40-question adaptive assessment for your child and an AI-generated report shared with you in your parent dashboard, is included in the Free Trial at no additional charge. We may also make it available on its own, without a Free Trial and without collecting payment information, to families arriving through a specific invitation link; where that applies it is stated on the link you followed.
The AI-generated report is informational. It does not constitute formal educational assessment, diagnosis, placement decision, or professional advice. See "Children's interaction data and AI processing" and the Privacy Policy for how the report is produced and how the underlying data is handled.
A paid Subscription is required to access ongoing adaptive practice, quests, and the parent-facing practice dashboards. The features included in the Free Assessment and in a Subscription are described on the pricing page and may evolve over time, with material reductions communicated under "Service availability and changes" below.
Subscriptions, free trial, and billing
Free Trial
When we offer a Free Trial of the paid Service, the duration is shown to you before you start it. During the Free Trial you have full access to the features included in the plan, including the initial assessment and the report it produces, at no charge.
We collect payment information when you sign up for a Free Trial. You are charged nothing on the day you provide it. Before you enter your payment details we show you, on the same screen and above the payment fields, the amount of the first charge, the exact calendar date it will be taken, and the billing frequency after that.
At the end of the Free Trial the Subscription begins automatically and the first charge is taken, unless you cancel before then. If your Free Trial is longer than seven (7) days when it starts, we will send you a reminder by email at least seven (7) days before that first charge, stating the amount, the date, and how to cancel. If it is seven (7) days or shorter, the confirmation email we send when it starts states the amount, the date, and how to cancel, and serves as that reminder. You may cancel at any point during the Free Trial, from the parent dashboard or from the Stripe customer portal we provide; if you cancel before the Free Trial ends, no charge is taken at all.
The length of a Free Trial may differ between families, for example where you arrived through a partner link that carries a longer trial. The length that applies to you is the one shown to you at checkout and in your dashboard. We may extend a Free Trial, for example when you ask us to, and your dashboard then shows the new first-charge date. If more than seven (7) days are left before that charge when we extend it, we will send you a reminder by email at least seven (7) days before it, stating the amount, the date, and how to cancel.
If you are charged at the end of a Free Trial and decide the Service is not right for your family, our money-back guarantee applies to that first charge as described under "Cancellation and refunds" below. Your child's work and progress are retained in line with our Privacy Policy, so nothing is lost if you cancel and subscribe again later.
Paid plans and billing
A Subscription begins either at the end of a Free Trial you did not cancel, or immediately if you start one without a Free Trial. Once started, the Subscription continues on a recurring basis at the price shown to you at the time you signed up, and renews automatically at the end of each billing period until you cancel.
Playful Digits SRL is the merchant of record and the counterparty to the Subscription. We issue your invoice. Payments are processed on our behalf by Stripe Payments Europe, Ltd. ("Stripe"), our payment processor. Stripe receives your card details directly; we do not see or store full card numbers. Stripe is named as a subprocessor in our Privacy Policy and in Annex A of the Data Processing Agreement.
Playful Digits SRL is not currently registered as a VAT payer in Romania. The price shown at checkout is the full amount you pay; no VAT is added to your invoice. If our revenue passes the threshold that requires VAT registration, we will let you know in advance and update these Terms before any VAT begins to be added.
If a payment fails, we may retry the charge for a reasonable period. If the payment cannot be collected, we may suspend or terminate the Subscription.
Price changes
We may change the price of the Service from time to time. Any change to the price of an existing Subscription will be communicated to you at least thirty (30) days in advance, and the new price will only take effect at the start of a new billing period. You may cancel before the change takes effect if you do not agree to it.
Cancellation and refunds
You may cancel your Subscription at any time from the parent dashboard or from the Stripe customer portal we provide. Cancellation takes effect at the end of the current paid billing period; you keep access until then, and we do not pro-rate refunds for unused time within a paid period unless required by applicable law.
For European Union consumers, the statutory right of withdrawal under Directive 2011/83/EU (as transposed into Romanian law) applies to digital-services contracts for fourteen (14) days after the contract is concluded. By starting your paid Subscription before the end of that period, you may be asked to expressly request immediate performance and acknowledge that doing so will cause you to lose the right of withdrawal once the Service has been fully performed. Where the Service has been only partially performed, the right may apply on a pro-rated basis.
Money-back guarantee on your first charge. If you are charged at the end of a Free Trial, or on your first payment where no Free Trial applied, and you tell us within thirty (30) days of that charge that the Service is not a fit for your family, we will refund it in full. Write to us at moc.htampulevel@lagel and we will process it. This is a contractual promise in addition to, and not in place of, the statutory rights described above.
Beyond the money-back guarantee and the statutory rights described above, we may offer goodwill refunds in exceptional circumstances at our sole discretion. We do not promise an outcome-based refund (for example, a refund tied to a child's test scores or measurable improvement). Educational outcomes depend on many factors outside our control, and we would not be acting in good faith by guaranteeing them.
To request a refund or to discuss billing, write to us at moc.htampulevel@lagel.
Service availability and changes
We work hard to keep the Service running, but we do not promise uninterrupted access. Planned maintenance, third-party outages, internet incidents, and force-majeure events may cause occasional downtime. Where downtime is foreseeable, we will give reasonable notice in advance.
We may add, remove, or change features of the Service over time. Where a change materially reduces the functionality of a feature you actively rely on, we will notify you in advance and, where practical, offer alternatives or migration support.
We reserve the right to discontinue the Service entirely on at least sixty (60) days' notice. In that case, we will pro-rate any unused portion of a paid Subscription and help you export your data before access is removed.
Intellectual property
The Service, the Content (including AI-generated reports we produce for you), the brand assets (including the Level Up name and logo system), and all underlying software remain the property of Playful Digits SRL or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational use by you and the children on your Account, subject to these Terms.
Nothing in these Terms transfers ownership of any intellectual-property right to you. You agree not to use the brand assets (logo, name, marketing copy) outside the Service without our prior written consent.
Children’s interaction data and AI processing
Level Up performs adaptive assessment dynamically. As children answer problems, request hints, and progress through skills, the Service uses their responses to figure out what they know, what they do not yet know, and which gap to work on next. We process this assessment data (problem responses, attempts, hint requests, time spent per item, and the resulting skill placement) solely to deliver, secure, and improve the Service. We do not sell or rent it, and we do not use it to deliver targeted advertising to children. As parent, you grant us a limited, world-wide, royalty-free license to process that assessment data for these purposes only.
Level Up has no social features: there is no chat, messaging, comments, forums, or any way for users to see or contact one another, and children cannot post content. There is no user-generated content, so there is nothing for other users to see and nothing for us to moderate.
We use third-party large-language-model services, currently Anthropic Claude Opus, to generate the AI-written narrative portion of the report we share with you after the Free Assessment, and to assist with limited adaptive features. The input we send to those services is a pre-computed assessment brief derived from your child's responses; we do not send raw item-bank internals or any of your child's directly identifying data such as last name, photo, voice, or contact details. The AI-generated output is informational, is validated by our adaptive engine before it reaches your dashboard, and does not by itself produce any legal or similarly significant effect on you or your child. Our AI subprocessors are contractually prohibited from using your data to train their models.
Aggregated, anonymised statistics derived from interaction data (for example, "75% of 5th graders found this problem easy") may be used to improve our adaptive engine and curriculum. Aggregation is performed in a way that prevents re-identification of any individual child.
The Privacy Policy describes the AI processing in more detail, including the legal basis, retention, and your rights.
Disclaimers
The Service is provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, about the Service, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free, secure, or uninterrupted. Where applicable consumer-protection law grants you statutory rights that cannot be excluded, those rights are not affected by this section.
Level Up is an adaptive practice tool. It supplements, but does not replace, formal schooling, certified instruction, or professional educational assessment. We do not promise specific learning outcomes for any individual child.
Limitation of liability
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law (for example, liability for fraud, gross negligence, or death or personal injury caused by negligence).
Subject to that, our total aggregate liability to you for any and all claims arising out of or relating to the Service or these Terms, whether in contract, tort, breach of statutory duty, or otherwise, is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred euro (€100).
We are not liable for indirect or consequential losses, loss of profits, loss of revenue, loss of business, loss of goodwill, or loss of data caused by use or inability to use the Service, except where such liability cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Playful Digits SRL, its officers, employees, and contractors from and against any third-party claims, damages, liabilities, and reasonable legal costs arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) content or instructions you submit that infringe a third party's rights. This section does not apply to claims that arise from our own breach of these Terms or from our negligence.
Operator details

Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Romania, excluding rules on conflicts of law. The courts of Bucharest, Romania have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that consumers domiciled in another EU member state retain the mandatory protections and forum-of-domicile rights granted to them under their local law.
For consumer disputes, the European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Use of the platform is voluntary; we are not obliged to participate, but we may choose to do so.
Changes to these terms
We may update these Terms from time to time to reflect changes in our practices, our legal obligations, or the Service itself. Where a change is material and adverse to your rights, we will notify you at least thirty (30) days in advance, for example by email or through a prominent notice in the Service. Where a change is required by law or addresses a security risk, we may apply it sooner and let you know promptly.
Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not accept a change, you may cancel your Subscription before the effective date and stop using the Service.
